Your cyber and Tech E&O policy was underwritten based on a specific risk profile: a B2B SaaS company that provides deterministic software to business customers. The underwriter assessed your data handling practices, your security posture, your contractual commitments, and the nature of your service. They priced the policy accordingly.
Then you added AI features. Your product now routes customer data to a third-party LLM provider. It generates outputs that are non-deterministic and may be inaccurate. It processes data through a subprocessor chain that did not exist when the policy was written. Your contractual commitments may include (or may fail to include) AI-specific warranty disclaimers, training provisions, and output indemnification terms that change your liability exposure.
Your insurance coverage may not have kept up.
This post covers how AI features change your risk profile, what underwriters are now asking about AI, where the common coverage gaps are, and how your contractual commitments interact with your insurance in ways most companies do not think about until they are filing a claim.
How AI Changes Your Risk Profile
Adding AI features does not create entirely new categories of insurable risk. It shifts the probability and magnitude of risks your policy already covers, and it introduces edge cases that may fall between coverage categories.
Your cyber risk profile changes because you are now sending customer data to an additional third-party processor. The data flow map from the first post in this series is directly relevant here: every additional layer in the processing chain is an additional point of potential compromise. Your LLM provider’s security posture is now part of your attack surface. If your provider experiences a breach that exposes customer data you sent through the API, your cyber policy responds, but the investigation and response will involve a third party whose systems you do not control and whose cooperation in an incident response may be governed by their terms of service rather than your preferences.
Your Tech E&O risk profile changes because AI outputs are a new category of professional service error. If your product generates a recommendation that a customer relies on and the recommendation is wrong, the resulting claim looks like a Tech E&O claim: your technology failed to perform as represented, and the customer suffered a loss. But traditional Tech E&O was underwritten for software bugs (deterministic failures with identifiable causes), not for hallucinations (probabilistic failures where the output looks correct but is not). The claims profile is different, and your underwriter may not have priced for it.
Your IP risk profile changes because AI-generated outputs may infringe third-party intellectual property. As discussed in the earlier post on AI outputs, the copyright status of AI training data is the subject of over 50 pending lawsuits. If your customer uses an AI-generated output from your product and a third party brings an infringement claim, the question is whether your policy covers it. Standard Tech E&O policies cover IP infringement claims arising from your technology. Whether that extends to content generated by your technology using a third-party model is a coverage question your current policy may not clearly answer.
What Underwriters Are Asking
Insurance applications and renewal questionnaires for technology companies have started including AI-specific questions. The questions vary by carrier, but the common themes are consistent.
Underwriters want to know whether your product incorporates AI or machine learning features, what third-party AI models or APIs you use, whether customer data is used to train AI models (and if so, under what conditions and with what consent mechanisms), what guardrails and safety measures you have implemented around AI outputs, whether your customer-facing terms include AI-specific warranty disclaimers, and whether you have had any claims or incidents related to AI outputs.
These questions matter because your answers directly affect your coverage terms and pricing. If you disclose that you use AI but have not updated your contracts to include AI-specific disclaimers, the underwriter sees a gap between your risk profile and your contractual risk management. That gap may result in higher premiums, additional exclusions, or a requirement to update your terms before coverage is bound.
For established vendors adding AI features to an existing product, the timing matters. If your policy was renewed before you added AI features, you may have a mid-term disclosure obligation. Most policies require you to notify the insurer of material changes to your risk profile during the policy period. Adding AI features that change how you process customer data and what outputs your product generates is arguably a material change. Check your policy’s notification requirements and talk to your broker about whether a mid-term disclosure is needed.
The AI Exclusion Problem
As discussed in the main series post on cyber insurance and Tech E&O, some insurers are writing AI exclusions into their policies and attempting to sell separate standalone AI policies. This is a developing area, and the market has not settled.
The position to take: a well-drafted combined cyber and Tech E&O policy should not exclude AI, and a standalone AI policy should not be necessary. AI features are a component of your technology product. They create risk that falls within the existing coverage categories (cyber for data incidents, Tech E&O for professional service errors, IP for infringement claims). Carving AI out of the base policy and requiring a separate policy for the same risk creates coverage gaps, increases costs, and adds complexity that does not serve the policyholder.
If your carrier is proposing an AI exclusion at renewal, push back. Ask your broker to obtain competing quotes from carriers that do not exclude AI. If the exclusion is broad (excluding any claim “arising from or related to artificial intelligence”), it could gut your coverage for the precise risk category that AI features introduce. If the exclusion is narrow (excluding specific categories like autonomous decision-making or generative content), evaluate whether the excluded categories apply to your product and negotiate accordingly.
Enterprise customers are not asking for standalone AI insurance policies. They are asking for proof that your existing cyber and Tech E&O coverage is adequate for the product you are selling them, including its AI features. A combined policy that covers AI without exclusion is the cleanest answer to that question.
How Your Contracts Affect Your Coverage
Your contractual commitments interact with your insurance coverage in ways that most companies do not think about until a claim is filed.
Your liability cap determines your maximum contractual exposure, which in turn determines how much of a claim your insurance needs to cover. As emphasized in the main series insurance post, do not agree to cap your liability at the amount of available insurance. Your policy limit may need to be shared across multiple customers in the event of a breach. If one customer’s contract ties your liability to your insurance limit and an incident affects multiple customers, that one customer could consume the entire policy limit, leaving you uninsured for claims from every other affected customer. Keep your liability cap as a function of revenue (typically 12 months of fees paid), not as a function of available insurance.
Your indemnification structure determines which claims your insurance responds to. If you have indemnified customers for AI output IP infringement without upstream indemnification from your LLM provider (as discussed in the posts on AI outputs and LLM provider contracts), you have created an indemnification obligation that your Tech E&O policy may or may not cover. Review your indemnification commitments against your policy’s coverage for IP claims and confirm that the scope matches.
Your warranty disclaimers affect your claims defense. If your contracts include AI-specific disclaimers (outputs are non-deterministic, should be independently verified, are not guaranteed accurate), those disclaimers strengthen your defense against Tech E&O claims arising from output inaccuracy. If your contracts rely on a generic as-is disclaimer that does not specifically address AI, the defense is weaker. And if your marketing contradicts your disclaimers (the AI-washing problem discussed in the post on AI outputs), a claimant will use that contradiction against you, and your insurer’s willingness to defend may be affected.
Your data training commitments affect your cyber exposure. If you have committed to no-training and your LLM provider’s terms do not support that commitment (as discussed in the post on LLM provider contracts), you have a contractual breach risk that could trigger claims from multiple customers simultaneously. A multi-customer claim arising from a single contractual breach is exactly the scenario where your policy limits come under pressure.
Practical Steps
Before your next renewal, do the following.
Review your current policy for AI exclusions. If exclusions exist, understand their scope and negotiate their removal or narrowing with your broker.
Disclose your AI features to your broker and underwriter. If you added AI features since your last renewal, proactive disclosure is better than a mid-claim coverage dispute. Provide the data flow map from your AI features, your LLM provider’s identity and terms, and your customer-facing AI disclaimers.
Align your contractual commitments with your coverage. Review your liability caps, indemnification structure, and warranty disclaimers against your policy terms. The goal is no gap between what your contracts expose you to and what your policy covers.
Fix your contracts first, then renew. If your terms lack AI-specific disclaimers, your subprocessor list is incomplete, or your indemnification structure creates unfunded exposure, fixing those issues before renewal gives you a stronger underwriting story and potentially better terms.
Model the multi-customer scenario. If your product has an AI feature used by hundreds of customers and a single incident (a data breach at your LLM provider, a training data lawsuit, a widespread hallucination issue) affects all of them simultaneously, what is your aggregate exposure? Does your policy limit cover it? Does your liability cap structure protect you? These are the scenarios underwriters think about. You should think about them too.
